CONSENT FOR COLLECTION AND PROCESSING OF KYC DOCUMENTS

By submitting or uploading your PAN Card, Aadhaar Card, Passport, bank statements, address proof, photographs, or any other identity and verification documents (“KYC Documents”) to PayFX Global, you (“Customer”, “User”, or “you”) expressly consent to the collection, storage, verification, processing, and use of such information by PayFX Fintech Solutions Private Limited, operating under the brand name PayFX Global (“PayFX Global”, “Company”, “we”, “our”, or “us”).

PayFX Global collects and processes such information in accordance with:

• The Information Technology Act, 2000;
• Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011;
• Digital Personal Data Protection Act, 2023 (“DPDP Act”);
• RBI/FEMA guidelines;
• Anti-Money Laundering (“AML”) regulations;
• Know Your Customer (“KYC”) obligations;
• Applicable financial and regulatory requirements.

1. PURPOSE OF COLLECTION
Your KYC Documents and personal information may be collected and processed for purposes including:

• Identity verification;
• Customer onboarding;
• KYC and AML compliance;
• Fraud prevention and risk assessment;
• Regulatory and legal compliance;
• Transaction processing and verification;
• Foreign exchange and remittance compliance;
• Audit, security, and record-keeping purposes.

2. CONSENT FOR PROCESSING

By providing your documents and information, you:

• Confirm that the information provided is true, accurate, and belongs to you;
• Authorize PayFX Global to verify the authenticity of the submitted documents;
• Consent to electronic storage, processing, and sharing of information with authorized banking, financial institution, verification, compliance, and regulatory partners where required;
• Acknowledge that such processing may continue for the duration required under applicable laws and regulatory obligations.

3. AADHAAR CONSENT

Submission of Aadhaar information is voluntary unless specifically mandated under applicable law.

Where Aadhaar information is provided:

• It shall be collected only with your explicit consent;
• It shall be used solely for lawful verification and compliance purposes;
• You may alternatively provide any other officially valid document permitted under applicable regulations.

PayFX Global shall not deny services solely because Aadhaar information is not provided where alternative documentation is legally acceptable.

4. DATA SECURITY

PayFX Global implements commercially reasonable security practices and procedures to protect your information from:

• Unauthorized access;
• Misuse or disclosure;
• Alteration or destruction;
• Cybersecurity threats and fraud.

Security controls may include encryption, restricted access controls, secure storage systems, monitoring mechanisms, and compliance procedures.

5. DATA SHARING AND DISCLOSURE

Your information may be shared only with:

• Regulated banking and financial institution partners;
• KYC and verification agencies;
• Payment processors and compliance providers;
• Government, regulatory, judicial, or law enforcement authorities where legally required.

PayFX Global does not sell customer personal information to third parties.

6. DATA RETENTION

Your documents and personal information may be retained for the period required under:

• RBI regulations;
• FEMA guidelines;
• AML/KYC obligations;
• Taxation and audit laws;
• Applicable Indian legal and regulatory requirements.

7. CUSTOMER DECLARATION

By proceeding, you confirm that:

• You have read and understood this consent notice;
• You voluntarily provide your documents and information;
• You authorize PayFX Global to process such information for the purposes stated above;
• You understand your rights under applicable Indian data protection laws.
